Nobody reads these willingly. We know. But this document is legally binding and covers your rights and responsibilities when you use our store, website, and services (collectively, the "Services"). Weird Pigeon operates this store, powered by Shopify.

By visiting, browsing, or purchasing from our Services, you agree to these Terms of Service and our Privacy Policy. If you don't agree, the exit is wherever you found the back button.

The terms "we", "us", and "our" refer to Weird Pigeon. "You" is you. Yes, you specifically.

Your account is your responsibility. You are solely responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or licence your account to anyone else.

We make every effort to represent our products accurately on the site. That said, colours and product appearance may differ from what you see on screen — this depends on your device, display settings, and general chaos of the universe.

We do not warrant that product quality or appearance will match your expectations or exactly match what is depicted in our online store. Product descriptions are subject to change at any time without notice, at our discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person or region.

Section 3 — Orders

Placing an order is an offer to purchase — not a confirmed sale. Weird Pigeon reserves the right to accept or decline your order for any reason, at its discretion. Your order is not accepted until we confirm acceptance and successfully process your payment.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order has been accepted. If we decline, change, or cancel your order, we will attempt to notify you via the email, billing address, or phone number provided at the time of purchase.

Returns and exchanges are handled exclusively in accordance with our Refund Policy [LINK TO REFUND POLICY].

You confirm that your purchases are for personal or household use only and not for commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for any product or service will be the price in effect at the time your order is placed, as confirmed in your order confirmation email.

Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges. Prices in our online store may differ from prices in physical stores or third-party platforms. Promotions are governed by their own terms; in case of conflict, promotion terms take precedence.

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once your order is handed to the carrier, title and risk of loss passes to you.

If your parcel ends up in a sorting facility limbo for three weeks: we feel that. We really do. But it's between you and the carrier at that point.

All content on our Services — including but not limited to trademarks, brand identity, text, images, graphics, product designs, video, and audio — is owned by Weird Pigeon, its affiliates, or licensors, and is protected by applicable Swiss and international intellectual property laws.

You may use our Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our Services without our prior written consent.

Weird Pigeon's name, logo, product and service names, designs, and slogans are trademarks of Weird Pigeon or its affiliates. You may not use these without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify Inc. All other marks belong to their respective owners.

Unauthorised use of our intellectual property may constitute a violation of applicable law. All rights not expressly granted are reserved.

Section 7 — Optional Third-Party Tools

We may provide access to third-party tools as part of our Services. These tools are provided "as is" and "as available" — we do not monitor, control, or warrant them, and we are not liable for anything arising from your use of them.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with Weird Pigeon.

You agree that your Feedback will not violate any third-party rights, contain unlawful or abusive content, include malware, or misrepresent your identity. You are solely responsible for your Feedback and its accuracy.

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

In plain terms: we sell good stuff and we care about quality. But legally, we can't promise perfection — and neither can anyone else.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WEIRD PIGEON, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AND THOSE OF SHOPIFY AND ITS AFFILIATES — SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM.

Section 17 — Indemnification

You agree to indemnify, defend, and hold harmless Weird Pigeon, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable legal fees — arising from: (1) your breach of these Terms or any document incorporated herein; (2) your violation of any law or third-party right; or (3) your access to or use of the Services.

We will notify you of any indemnifiable claim. We may control the defence and settlement of such claims at your expense, but will not settle any claim requiring non-monetary obligations from you without your prior consent (not to be unreasonably withheld). You agree to cooperate in the defence of such claims.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law. The unenforceable portion shall be deemed severed from these Terms, without affecting the validity or enforceability of any remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules posted on this site, constitute the entire agreement between you and Weird Pigeon regarding your use of the Services, and supersede any prior agreements, communications, or proposals — oral or written.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Section 20 — Assignment

You may not delegate, transfer, or assign these Terms or any rights or obligations under them without our prior written consent. Any such attempt is null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Section 21 — Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Switzerland, specifically the canton of Aargau. You and Weird Pigeon consent to the exclusive jurisdiction of the courts of Baden, Aargau, Switzerland for any disputes arising from these Terms or your use of the Services.

Section headings are included for convenience only. They do not limit or otherwise affect the interpretation of these Terms.

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website.
